Eliminate ‘Personal Pricing’ and You Risk Harming Consumers

The latest consumer protection crusade across the US has an odd target in its sights: discounts.

Earlier this month, the New York State Legislature passed the One Fair Price Act, which would ban personalised pricing — the practice of using data to offer different prices to different customers. The bill now sits on Governor Kathy Hochul’s desk. Two days earlier, Governor Jared Polis of Colorado vetoed his own state’s version of the same idea. His explanation got to the heart of the problem: the bill, he wrote, “would punish differentially lower prices, not just higher prices”.
