ICLE Research Cited in Mercatus Center Brief on State Antitrust Enforcement
The Mercatus Center cited ICLE’s comments on state laws with national economic effects and other ICLE research in a policy brief by Alden Abbott on state antitrust enforcement. The brief also references Babette Boliek’s analysis of California’s COMPETE Act and work on competition in technology markets as it examines the uncertainty and conflicting remedies that can follow overlapping state and federal challenges. The International Center for Law and Economics’ (ICLE’s) work on state laws with national spillovers similarly stresses that state experimentation becomes harmful when one jurisdiction exports costs to the interstate economy.15A rule that waits for every state sovereign to become comfortable with an unfamiliar technology will systematically favor incumbency over experimentation.
Babette Boliek’s July 2026 ICLE critique argues that the bill would replace objective consumer-welfare analysis with protection of favored trade participants.22
