The dispute between music publishers and ISPs underscores the difficult position the parties find themselves in, with the publishers playing “a game of Whac-a-Mole” trying to protect their copyrights, and ISPs having to be “much more aggressive in policing piracy,” said Kristian Stout, director of innovation policy at the International Center for Law & Economics, a privately funded research group. “There’s kind of a middle ground that needs to be struck,” Stout said. “I don’t think ISPs should be facing billion-dollar treble damages in most cases, but you definitely need to have some kind of repeat infringer policy that gets respected.”
