Implementing DMA and DSA in France: Analysis of the Institutional Architecture and Regulatory Dynamics
Abstract
The law of 21 May 2024 aimed at securing and regulating the digital space implemented in French legal order the European regulations on digital markets and digital services. It has allocated the new responsibilities associated with the enforcement of these texts between regulatory authorities with horizontal jurisdiction (such as the Autorité de la concurrence) and regulatory authorities with vertical jurisdiction (such as Arcom and the CNIL). The purpose of this chapter is to analyse this new institutional framework and to shed light on the dynamics that may result from it in terms of guaranteeing competitive order and economic public order in response to the challenges posed by the major digital ecosystems and the manipulations they may entail.
