The International Center for Law and Economics submitted a formal comment on July 24, 2026, calling on the FTC to revise the policy statement to provide clearer, fact-specific guidance and to limit enforcement to conduct that falls within Section 5 and complies with the First Amendment. Industry commenters have also raised First Amendment concerns: AI model design decisions involve editorial choices about what outputs to produce, and enforcing Section 5 against those decisions could penalize particular viewpoints rather than false commercial statements.
